Terms and Conditions

Everzocial, LLC Terms of Service and SMS Messaging Terms

These Terms of Service (“Terms”) govern your access to and use of the Everzocial website and any related pages, forms, scheduling tools, and online services (the “Site”), located at https://everzocial.com, and operated by Everzocial, LLC (“Everzocial,” “we,” “us,” “our”).

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1) Who We Are

Everzocial provides digital marketing, sales enablement, and business strategy services. We may also provide resources, content, templates, case studies, or educational materials.

2) Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Site.

3) Acceptable Use

You agree to use the Site only for lawful purposes and in a way that does not harm others or interfere with the Site.

You agree not to:

8) Your Submissions

If you submit information or materials through the Site (contact forms, comments, files, testimonials, creative assets, etc.), you represent you have the right to provide them.

You grant Everzocial a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your submissions only as needed to:

  • respond to you,
  • provide services,
  • operate and improve the Site, and
  • maintain business records.

9) Links and Tools From Other Providers

We may use or link to tools, analytics, email platforms, scheduling tools, and other services operated by other companies. Those services may have their own terms and privacy practices. We are not responsible for content, policies, or practices outside our Site.

Examples may include analytics and marketing tools (such as Google Analytics), email platforms, CRM systems, or data enrichment tools.

11) SMS Messaging Terms (GHL / A2P 10DLC / Carrier Compliance)

These SMS Terms apply if you opt in to receive text messages from Everzocial.

11.1 Program Description

If you opt in, you may receive text messages related to:

  • appointment confirmations and reminders,
  • scheduling and rescheduling updates,
  • responses to inquiries you submit,
  • service or account updates,
  • customer support communications, and
  • (only if you separately opt in) marketing or promotional messages.

11.2 How You Opt In

Opt-in is collected via forms, scheduling pages, or other methods that clearly request SMS consent (such as an unchecked checkbox). You may also opt in through other clear, affirmative actions where allowed.

Consent is not required as a condition of purchase.

11.3 Message Frequency

Message frequency varies based on your interactions, appointment activity, and the type of messages you opt in to receive.

11.5 Opt-Out (STOP)

11.7 Carriers

Wireless carriers are not liable for delayed or undelivered messages.

11.9 Privacy for SMS

We do not provide your mobile number or SMS opt-in information to other companies for their own marketing. We use service providers and systems to send and manage messages and to keep records of opt-ins and opt-outs.

12) Disclaimers

THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, secure, or error-free.

13) Limitation of Liability

To the maximum extent permitted by law, Everzocial and its owners, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill.

If liability is imposed, our total liability for any claim related to the Site will not exceed the amount you paid to us (if any) for Site access or Site-related services during the six (6) months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations. In that case, limitations apply to the fullest extent permitted.

14) Indemnification

You agree to defend, indemnify, and hold harmless Everzocial from claims, liabilities, damages, judgments, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • your use of the Site,
  • your violation of these Terms, or
  • your violation of any law or the rights of another.

15) Termination

We may suspend or terminate access to the Site at any time, without notice, if we believe you violated these Terms or used the Site in a harmful or unlawful way.

16) Changes to These Terms

We may update these Terms from time to time. We will update the Effective Date or Last Updated date at the top when changes are posted. Your continued use of the Site after changes are posted means you accept the updated Terms.

17) Governing Law and Venue

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any dispute related to these Terms or the Site must be brought in the state or federal courts located in Hamilton County, Ohio, and you consent to jurisdiction and venue there.
